1. Overview

This website is operated by Mahjelly. Throughout the website, the terms “Mahjelly,” “we,” “us,” and “our” refer to Mahjelly.

These Terms of Service govern your access to and use of our website, online store, products, content, features, and related services.

By visiting our website, creating an account, or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree to these Terms, you should not use the website or place an order.

2. Eligibility

You must be legally capable of entering into a binding contract in your place of residence to make a purchase.

If you are under the legal age of majority, you may use the website or place an order only with the permission and supervision of a parent or legal guardian.

You are responsible for ensuring that the information you provide is complete, current, and accurate.

3. Store Platform

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell products to you.

Your use of certain checkout, payment, account, or other Shopify-powered features may also be subject to Shopify’s applicable terms and privacy practices.

4. Primary Market and Sales Destinations

Mahjelly primarily serves customers located in the United States.

We also accept eligible orders for delivery to addresses in Australia. We do not currently ship to other countries unless expressly stated at checkout.

Product availability, pricing, currency, taxes, payment methods, shipping charges, and delivery estimates may vary depending on the customer’s location.

Prices for United States customers are generally displayed in U.S. dollars unless another currency is clearly shown at checkout. The final currency and total payable will be displayed before the order is submitted.

We may decline an order if we cannot legally or operationally deliver to the supplied address. If payment has already been collected, it will be refunded to the original payment method.

5. Products and Availability

We make reasonable efforts to display product descriptions, measurements, materials, colours, and images accurately.

Colours and appearance may vary slightly because of lighting, photography, manufacturing variations, and differences between device displays. Nothing in this section permits a product to be materially different from its description or removes any applicable consumer guarantee.

All products are subject to availability. Placing an item in your cart does not reserve it.

We may limit product quantities where reasonably necessary to manage inventory, prevent fraud, or ensure fair availability.

6. Orders

Submitting an order represents an offer to purchase the selected products.

After an order is submitted, you will receive an electronic confirmation. We may review the order before fulfilment.

We may cancel or decline an order for legitimate reasons, including:

A product being unavailable.
Payment not being authorised.
An incomplete or invalid delivery address.
Suspected fraud or unauthorised activity.
An obvious pricing or product-information error.
A legal or shipping restriction affecting the order.

If we cancel an order after payment has been collected, we will issue a full refund to the original payment method.

7. Prices, Taxes, and Payment

Prices are displayed in the currency shown on the website or at checkout.

Applicable product prices, shipping charges, taxes, duties, discounts, and order totals will be displayed before you complete payment where reasonably possible.

You agree to provide valid and authorised payment information. By submitting payment, you confirm that you are authorised to use the selected payment method.

Banks and payment providers may apply currency-conversion charges or other fees that are outside Mahjelly’s control.

If a pricing error is obvious and could reasonably have been recognised as an error, we may contact you to confirm the correct price or cancel and refund the order.

8. Shipping and Delivery

Shipping destinations, processing times, estimated delivery times, tracking, and address requirements are described in our Shipping Policy.

Delivery dates are estimates unless we expressly agree otherwise. Carrier disruptions, customs processes, severe weather, public holidays, and circumstances outside our reasonable control may affect delivery.

Nothing in this section limits any right to a remedy where goods are not supplied within a reasonable time under applicable consumer law.

Customers are responsible for providing a complete and accurate shipping address. Contact us promptly if you discover an error. Address changes cannot be guaranteed after processing has begun.

9. Returns, Refunds, and Consumer Guarantees

Returns and refunds are governed by our Return & Refund Policy.

For eligible returns, Mahjelly will issue the refund to the original payment method within 1 business day after receiving the returned item. The customer’s financial institution may require additional time to post the refund.

Nothing in these Terms or our Return & Refund Policy excludes, restricts, or modifies rights that cannot lawfully be excluded.

For Australian consumers, our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Customers in the United States may also have rights under applicable federal and state consumer protection laws.

10. Accounts and Security

You may be able to create a customer account. You are responsible for:

Providing accurate account information.
Protecting your password and login credentials.
Restricting unauthorised access to your account.
Informing us promptly if you suspect unauthorised activity.

We are not responsible for losses resulting from your failure to protect account credentials, except where responsibility cannot lawfully be excluded.

13. Reviews and Submitted Content

If you submit a review, photograph, comment, suggestion, or other content, you confirm that:

You created it or have permission to submit it.

It does not violate another person’s rights.
It is not unlawful, abusive, defamatory, or harmful.

You grant Mahjelly a non-exclusive, worldwide, royalty-free licence to display, reproduce, and use submitted content in connection with operating and promoting Mahjelly.

We may remove submitted content that violates these Terms or applicable law. We will not manipulate or misrepresent genuine customer reviews.

14. Third-Party Services and Links

The website may contain links to or integrations with third-party services, including payment providers, shipping carriers, social media platforms, and Shopify services.

Third-party services are governed by their own terms and privacy policies. Mahjelly is not responsible for independent third-party content or services, except to the extent responsibility cannot lawfully be excluded.

Our collection, use, storage, and disclosure of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other service providers as required to operate the store, process payments, prevent fraud, and fulfil orders.

16. Errors and Website Information

Occasionally, information on the website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, or shipping.

We may correct errors and update information when reasonably necessary. If a correction materially affects an order already placed, we will notify you and provide an appropriate option, which may include confirming the change or cancelling the affected order for a refund.

We aim to keep the website available and secure but cannot guarantee uninterrupted or error-free access.

We may temporarily suspend parts of the website for maintenance, security, updates, or circumstances outside our reasonable control.

Temporary website unavailability does not affect orders already accepted or any rights available under applicable law.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including applicable consumer guarantees, fraud, wilful misconduct, or liability for death or personal injury where exclusion is prohibited.

To the maximum extent permitted by law, Mahjelly is not responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was formed.

Where liability may lawfully be limited, Mahjelly’s liability will be limited only to the extent permitted by applicable law.

19. Changes to These Terms

We may update these Terms to reflect changes to our services, business practices, technology, or legal obligations.

Updated Terms will be posted on this page with a revised “Last updated” date. Changes will apply prospectively and will not remove rights already attached to an accepted order.

20. Severability and No Waiver

If any part of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue to apply.

A failure by Mahjelly to enforce a provision on one occasion does not waive the right to enforce it later.

21. Governing Law and United States Customers

Mahjelly operates from New South Wales, Australia. These Terms are governed by the laws applicable in New South Wales, Australia, except where mandatory laws in the customer’s place of residence apply.

For customers located in the United States, nothing in these Terms excludes, restricts, or modifies any non-waivable rights or remedies available under applicable United States federal or state consumer protection laws.

Any governing-law or jurisdiction provision in these Terms applies only to the extent permitted by law. United States customers may bring a claim in any court, tribunal, or dispute-resolution forum available to them under applicable law.
